MASON, MI -- Taking several long pauses to compose himself and his voice shaking, Joseph Clewley delivered an emotional apology to the court for striking his 13-year-old son.

"I've had 50 percent custody of my boys since they were 3 and 5," he said at his sentencing hearing Monday. "I've raised them essentially as a single parent from 2004 to 2011 -- I just recently got remarried.

"I love my boys. I would do anything for my boys," Clewley said, fighting back tears.

Ingham District Judge Donald Allen sentenced Clewley to six months probation,$760 in fines and costs, anger management and counseling and five days of community service. Clewley is not allowed to patronize locations where alcohol or controlled substances are consumed.

Clewley, 46, of Leslie, struck his son on May 5, court records show. On May 24, he was charged with third-degree child abuse, a two-year felony, and suspended from the Ingham County Sheriff's Office.

"This incident I'm very sorry for," Clewley told Allen. "I reacted to an incident between the two of them (his sons)... I've taken extensive parenting classes. I have listened to audio, read two books, been to group therapy for parental concerns and how to raise children. I have learned a lot.

"I'm open to new theories and information on how handle stress, stress management, anger, and anger management. Continuing to search out answers on how to prevent this from happening again."

Clewley pleaded to a lesser charge of aggravated domestic violence, a three-year misdemeanor, in late June. He was terminated from the Sheriff's Office on July 19, according to Major Sam Davis. Clewley had served with the agency for 12 years, most recently as a detective.

Prior to Allen's ruling, Clewley's attorney, Nick Bostic, asked the judge to avoid jail time for his client. Bostic urged Allen to consider Clewley's circumstances.

"Obviously, people don't come into court as police officers and have any expectation of being treated special or getting a special break," Bostic said. "But we have a situation where Mr. Clewley has lost his employment...and it's the kind of job it's what you are, it's not just what you do. That's devastated him.

"(It was) a 30- or 45-second event that changed the course of his life."

Bostic also noted Clewley opted against invoking reasonable parental discipline as a defense.

"He dismissed it...because he did not want to put his children through that," Bostic said. "If you think that Joe Clewley is the kind of guy that would add stress and anxiety and burden his children for himself, then you don't know Joe Clewley."

Allen said he was not prepared to incarcerate Clewley, adding he had read "half a dozen or more" letters submitted in Clewley's defense. Some were from former law enforcment coworkers, and one was from Clewley's brother, explaining their upbringing, the judge said.

Allen asked what Clewley has learned thus far in his parenting counseling.

"Parenting is always a perpetual learning curve," Clewley responded. "I'm going to put the parenting styles I've learned into action as I slowly get more visitation with my boys and try to fix and repair the damage that I have done. I'm going to continue to seek help in trying to manage my life, the stress."

"So that's kind of where you're at, just a continued work in progress?" Allen asked.

"Yes sir," Clewley replied. "I assure the court that this will never happen again."

Allen said the sentence he imposed aims to bring Clewley's assertion to fruition.

"I want to make sure that this does not replicate itself," Allen said. "I'm encouraged by the fact that you're saying that it will not happen, but I want to make sure that we put in place safeguards to try and keep it from happening as well."

The conviction will be stricken from Clewley's record, Allen ruled, if he successfully completes the probation term. Clewley is scheduled for review in February 2013, court records show.

Joseph Clewley, 45, of Leslie, was sentenced to six months probation, $760 in fines and costs, and anger management and counseling. Ingham District Judge Donald Allen also ruled Clewley is not allowed to patronize locations where alcohol or controlled substances are consumed.

Clewley was originally charged with third-degree child abuse, a two-year felony, but pleaded to a lesser chargeof aggravated domestic violence, a three-year misdemeanor, in late June.

Clewley served with the Ingham County Sheriff's Office for 12 years. He was suspended from the agency on May 24, the same day charges against him were authorized.

The case was prosecuted by the Eaton County Prosecutor's Office. The Ingham County Prosecutor's Office recused itself due to Clewley's position with the county Sheriff's Office.

Allen ruled the criminal conviction will be removed from Clewley's record if he successfully completes probation. A violation of said probation could result in jail time.

Ingham County sheriff's Detective Joseph Clewley on Tuesday agreed to a plea deal reducing a felony charge resulting from his alleged abuse of his 13-year-old son in May to a misdemeanor.

The deal struck at a pretrial conference lessened a charge of third-degree child abuse, a two-year felony, to aggravated domestic violence, a one-year misdemeanor, according to Eaton County Senior Assistant Prosecutor Neil O'Brien.

Prosecutors offered Clewley, 46, of Leslie, the plea bargain after considering several important factors, O'Brien said.

"After we consulted with the child's mother and reviewed the facts, we believed that this was a fair and appropriate resolution to the case," he said. "In any case when you're talking about assaultive crimes, we're concerned from a law enforcement perspective of trying to make sure that there's going to be an impact that this prosecution has on people's behavior, and that's no different in this case."

Clewley, who has served with the Ingham County Sheriff's Office for the past 12 years, was arraigned on the child abuse charge on May 24, the same day the charge was authorized by prosecutors.

Ingham County sheriff's Chief Dep. Greg Harless previously said Clewley was suspended without pay from the department on May 24 before he was arraigned. Clewley remains suspended from work, Ingham County sheriff's Major Joel Maatman confirmed Tuesday.

The case was prosecuted by the Eaton County Prosecutor's Office. The Ingham County Prosecutor's Office recused itself due to Clewley's position with the county Sheriff's Office.

O'Brien added prosecutors were wary of calling on Clewley's son to testify against his father.

"The defendant, based on whether the case is resolved in a matter satisfactory to him, may have forced us into putting this boy on the stand, testifying against his dad to accomplish about the same outcome that we could have in this plea agreement," O'Brien said.

"There wasn't a major difference (between the two charges) in my mind. It was six of one, half a dozen of the other," he added, noting Clewley and his attorney, Nicholas Bostic, agreed to the plea deal.

O'Brien said Clewley was offered no special consideration due to his position in a law enforcement capacity.

"We are concerned with public perception of how the criminal justice system handles these matters," he said. "We're the public's agent on the side of law enforcement, but we still have to make decisions as to what the appropriate initial charge was and how to resolve it, regardless of who the defendant is.

"In this case, I don't believe it is different than just what a regular layperson defendant's outcome would have been. It's the media who seems to be focusing on who this defendant is."

Clewley is scheduled for sentencing before Ingham District Judge Donald Allen on Aug. 6 at 1:30 p.m.

MASON, MI -- An Ingham County sheriff's detective pleaded guilty to a lesser charge stemming from an incident that originally resulted in his being charged with third-degree child abuse of his 13-year-old son.

Joseph Clewley, 46, of Leslie, on Tuesday pleaded guilty to aggravated assault before Ingham District Judge Donald Allen, court records show. The charge is a misdemeanor punishable by up to one year imprisonment and a $1,000 fine.

Clewley, who has served with the Ingham County Sheriff's Office for the past 12 years, was arraigned on the child abuse charge on May 24, the same day the charge was authorized by prosecutors.

Ingham County sheriff's Chief Dep. Greg Harless previously said Clewley was suspended without pay from the department on May 24 before he was arraigned.

"As soon as we found out the charge was going to be issued he was suspended," Harless said earlier this month.

Clewley remains suspended from work, the Sheriff's Office confirmed Tuesday afternoon.

The alleged incidence of abuse occurred in May, court records show.

The case is being prosecuted by the Eaton County Prosecutor's Office. The Ingham County Prosecutor's Office recused itself due to Clewley's position with the county Sheriff's Office, Harless said.

Clewley is scheduled for sentencing on Aug. 6 at 1:30 p.m.

Calls placed to the Eaton County Prosecutor's Office and Clewley's attorney, Nicholas Bostic, were not immediately returned.

After pleading guilty to charges related to the July 2011 domestic violence attack, Officer Steven Luthy was placed back on duty [Kalamazoo PD] in February 2012.


KALAMAZOO, Mich. (WOOD) - A Kalamazoo Public Safety officer charged with domestic violence in 2011 has had the charges against him lowered and is now back on duty.

Sheriff's officials released the case details at the request of 24 Hour News 8 now that the case is closed.

Officer Steven Luthy was arrested in July 2011 after Van Buren County Sheriff's deputies responded to a 911 call at his home. The deputies found that Luthy's wife Ellen had visible injuries.
Ellen Luthy said she feared for her life the night of the attack.

"It was a pummeling far beyond anything I have ever experienced in my life," she said.

Luthy claimed that Ellen started the fight by throwing something at him, investigation documents show.

He was originally charged with domestic violence and placed on administrative leave. But in January, prosecutors changed the charge to misdemeanor disorderly persons and Luthy pleaded guilty.

Ellen, who filed for a personal protection order against her husband in August 2011, told 24 Hour News 8 that prosecutors contacted her about lowering the charges.

"I adamantly said that I felt very, very uncomfortable with that," said Ellen. "I felt it was up to the judge to decide what his fate should be."

Had the original charge of domestic violence stuck, Luthy would likely no longer be a police officer. Now, after a five-day suspension and a fine of less than $300, Luthy is back to work.

Ellen said she thinks that Luthy's charge was lowered, in part, because he is a police officer.

"There are certain positions, I believe, that there is a moral and ethical standard that's higher," she said.

Kalamazoo Department of Public Safety Chief Jeffrey Hadley told 24 Hour News 8 that the discipline from the department was appropriate.

Officer Luthy has not yet responded to requests for comment.

The Luthys are now in the process of divorcing.

KALAMAZOO — A Kalamazoo Department of Public Safety officer who pleaded guilty to a misdemeanor charge in a domestic violence case was given a five-day suspension Tuesday by Chief Jeff Hadley.

Steven V. Luthy, 37, of Bloomingdale, was charged with domestic violence following his arrest July 31 for an incident involving his wife at the couple's home. On Jan. 19, Luthy, a 10-year veteran of KDPS, pleaded guilty in Van Buren County District Court to a lesser charge of disturbing the peace.

After he entered his plea, a judge ordered Luthy to pay fines and costs in the case.

In addition to his suspension, Hadley said Luthy was removed from his assignment with the Kalamazoo Valley Enforcement Team and is to be reassigned to the agency's operations division.

Hadley said he expects Luthy to return to duty within a week to 10 days. He said Luthy, who has been on paid administrative leave since July, will lose five days worth of pay with the suspension.

Hadley said he reached the decision on Luthy's suspension after discussions with the city's labor attorney, human resources department and a review of past department practices.

“Looking at the case in its totality ... led us to the conclusion of the discipline that was rendered,” the chief said.

Luthy's wife, Ellen Luthy, told a Van Buren County circuit judge in a petition for a personal-protection order that during the July incident, her husband came home drunk, followed her around their house, hit her in the face and pushed her down some stairs.

The petition also alleged two other previous incidents of domestic violence going back two years.

SOUTH HAVEN — A Kalamazoo Public Safety officer scheduled to stand trial Thursday for misdemeanor domestic violence instead pleaded guilty to a lesser charge, authorities said.

Steven V. Luthy, 37, of Bloomingdale, appeared in Van Buren County District Court in South Haven and entered a guilty plea to one count of disturbing the peace, a misdemeanor punishable by up to 90 days in jail, a court official said.

A judge ordered Luthy to pay fines and costs in the case after he entered his plea. Luthy, a 10-year veteran of KDPS, was originally charged with domestic violence, a misdemeanor punishable by up to 93 days in jail, in connection with a July 31 incident involving his wife at their home.

Luthy's wife, Ellen Luthy, petitioned a Van Buren County circuit judge for a personal-protection order following the incident in July. She wrote to the judge that during the incident her husband had come home drunk, followed her around their house, hit her in the face and pushed her down some stairs.

The petition also alleged two other previous incidents of domestic violence going back two years.

Luthy has been on paid administrative leave at KDPS since his arrest in July.

“We will, in short fashion, complete the internal investigation and have a decision relative to discipline in the near future,” KDPS Chief Jeff Hadley said Thursday of Luthy's status with the department.

A judge in Kalkaska County has sentenced a South Boardman Fire Chief to a year probation.

James Killingsworth admitted to assaulting a teenager back on October 3rd.

Killingsworth told the judge that he pushed the victim down and hit the victim twice in the back of the head.

The teen was not injured.

The South Boardman Fire Chief admitted to assaulting a teenager. In court today, James Killingsworth said the assault happened at a home in South Boardman in Kalkaska County.

Killingsworth told the judge that back on October 3rd, he pushed the victim down, and hit the victim twice in the back of the head.

The teen was not hurt. Killingsworth will be sentenced in January.

After a full investigation by the Michigan State Police, Schultz was charged with misdemeanor domestic violence.

Tuesday, he was fined over $600 and will see no jail time unless he fails to pay the fines in a timely manner.

If the fines are not paid by October 15, Schultz will have to report to jail. He will have to spend one day for each $50 he owes.

According to officials, the incident occurred with a family member at the officer's home between 2005 and 2006.

Schultz resigned from the Ishpeming Police Department on Sunday.

ISHPEMING -- A former Ishpeming police officer, charged with one count of domestic violence, will be in court Tuesday afternoon. His name is not being released until after his arraignment.

The officer, who resigned from the Ishpeming Police Department Sunday, is charged with a misdemeanor.

Michigan State Police and Marquette County Prosecutor's Office investigated the allegations that were recently brought to their attention by the victim.

According to officials, the domestic violence incident happened in Marquette County at the officer's home between 2005 and 2006, with a family member.

Officials say the officer was on the force when the incident happened, but was not related to his work as an officer.

Authorities say the victim was not injured.

The officer is to appear in Ishpeming District Court Tuesday afternoon.

UNFORTUNATELY, ESSAD HAS NOT BEEN CHARGED WITH THE CRIMES HE COMMITTED WHILE ON PROBATION. HE IS SIMPLY FACING A REVOCATION HEARING TO DECIDE WHETHER HIS PROBATION WILL BE REVOKED. IF REVOKED, ESSAD WILL ONLY FACE 4 DAYS IN JAIL FOR HIS VICIOUS ATTACK ON HIS EX-WIFE [APRIL 2008], WHICH LEFT HER HOSPITALIZED.

Remember the standard for a probation violation hearing is simple Preponderance. That is just a hair over 50%.

Should Judge Kumar opt to violate his probation his special status under law, allowing his criminal record to be wiped clear, will evaporate and he will be forever barred from "serving" us as a Police Officer or owning a firearm. Given the severe injuries that Julie Essad endured ( he almost killed her) at the hands of this heavy handed "super" cop ( Use of Force Instructor etc.) who should have known better, I think Judge Kumar owes us one and should violate his probation and ensure that he spends Christmas in the Oakland County Jail.

I certainly hope that everyone will pick up a phone and contact Judge Kumar at 248-858-5280 so that she will understand not only what occurred, but the violent offender who uses extremely poor judgment that David Essad really is. Society needs to be protected, and he needs to be punished, and jailed as an example to others that no one is above the law

What was Essad's orignal jail sentence? Did the prosecutor just file a revocation hearing, or did they also file criminal charges against Essad for the crimes he committed when he violated his probation?

According to Circuit Court Records David Essad received a sentence of only 2 days per each of the two counts of Aggravated Domestic Violence.

The assumption being that Essad was credited with "time served".

No new criminal charges were filed to the best of my knowledge.

However in speaking with a reporter from the Oakland Press about the most recent incident according to their sources, resulted in no new charges or arrests by Sheriffs Deputies.

The Oakland County Circuit Court Case Lookup under David Essads Criminal Case only indicates that a revocation hearing will to be held.

The Prosecutor who brokered the deal was Ian Simons. A 2006/2007 Oakland County governement directory phone book indicates that Lisa Ortleib Gorcyca heads the Domestic Violence unit with their phone number being (248) 452-4177.

It is unknown if Assistant Prosecutor SImons is still assigned the case.

David Essads Probation Violation has once again been rescheduled to March 2, 2010 at 10:30 A.M.

I cannot believe the Oakland County Prosecutors Office and Judge Kumar are allowing this as Justice Delayed is Justice Deinied.

Should Essad successfully complete probation his criminal record will be wiped clear ( see his Felony Oakand County Circuit Court file and associated Register of Actions. If this happens and he may be allowed to return to duty as a Police Officer and own, carry and possess firearms.

David Essad has demonstrated poor judgement and is a violent individual who the public should be protected against.
