William Waite pled guilty in a domestic violence case.

GRAND TRAVERSE COUNTY -- The Grand Traverse County fireman who pled guilty in a domestic violence case was sentenced Wednesday. William Waite was sentenced to spend up to 93-days in jail with credit for time served.

According to the district court he will also spend two years on probation. The case stemmed from an argument with his girlfriend on New Year's Eve that turned violent.

The Assistant Chief of the Blair Township Fire Department says they are still reviewing the case and they have not made a decision on whether or not Waite will keep his job.

TRAVERSE CITY — A Grand Traverse County volunteer firefighter faces a criminal charge after police said he choked his girlfriend, then punched her in the face outside a downtown Traverse City hotel.

Grand Traverse County prosecutors charged William "Bud" Waite, 25, with a misdemeanor count of domestic violence, punishable by up to 93 days in jail and/or $500. Judge Thomas J. Phillips arraigned Waite on Wednesday in 86th District Court, and he remains free on a $1,000 personal recognizance bond.

Waite, a volunteer with the Grand Traverse Rural Fire Department, and his girlfriend got into an argument over an ex-girlfriend on Dec. 31 outside the Park Place Hotel in downtown Traverse City. She left but returned to the parking lot to check on Waite.

The woman told Traverse City police the argument continued in his vehicle, so she pushed him and he responded by punching her in the face, police reports show. She told police she ran away and called authorities.

Waite also is accused of choking the woman, but he contends her version is far from the truth.

"I don't agree with it," Waite said. "I did not do that."

A preliminary breath test showed Waite's blood-alcohol level was 0.068 percent at the time of his arrest, below the state's legal limit for intoxication, court records show. An officer also said his girlfriend had been drinking, police reports show.

Chefalo, Waite's attorney, believes the woman's story is "a lot more dramatic" because of her alcohol use when she spoke with police.

"His version of this is much different than hers," Chefalo said. "I think there's a happy medium here between a brutal attack and his description, which is very far from that."

Rural fire Chief Bill Sedlacek found out about the charge Wednesday, and said he has yet to discipline Waite or sift through the police report.

"I won't take any action until such a time as he is found guilty or innocent," Sedlacek said.

Waite's pretrial conference is set for Jan. 12 in 86th District Court.

TRAVERSE CITY -- A Blair Township firefighter and EMT is accused of assaulting a woman.

Wednesday morning, William Waite was arraigned in 86th District Court on a domestic violence charge.

Police say he assaulted his girlfriend in downtown Traverse City on December 31.

The Blair Township Fire Chief says Waite is still employed with the fire department pending the outcome of the court proceedings.

A pretrial hearing is set for January 12.

The 39-year-old St. Louis man charged with slamming his former girlfriend’s head on the pavement Wednesday was ordered held in lieu of $50,000 bond.

Joseph Anthony Naimo was arraigned in Gratiot County District Court on a charge of assault with intent to do great bodily harm less than murder, a maximum 10-year felony, and on a charge of aggravated assault, a misdemeanor, Gratiot County District Court Judge Stewart McDonald said.

Listed on a public database as a state corrections officer in Gratiot County, Naimo will have several restrictions placed on him if he makes bond. As of Friday afternoon he was still in jail, a Gratiot County sheriff’s deputy said.

If Naimo is released, he will be placed on an electronic tether that will monitor his location and alcohol or drug consumption, McDonald said. He will have to submit to random drug tests, he cannot visit a bar or consume alcohol, and he’s to have no contact with his alleged victim if he’s released from jail.

Police were called to Gratiot Medical Center in Alma following the early morning incident Wednesday.

According to investigators, Naimo’s former girlfriend, 35, was at his residence when the two got into a fight. She left, and a friend drove her to her home in St. Louis.

In the meantime, Naimo also got a friend to drive him to her home, and when she got out of the car, Naimo is alleged to have grabbed her by the hair and smashed her head three or four times on the pavement.

McDonald said he had seen photos of the injuries and described them as bloody.

The woman’s friend drove her to the hospital, where officials contacted the police. Her condition is unknown.

A preliminary exam has been scheduled for July 28.

A former Benzie County court officer has been sentenced to a year in jail.

Richard Zych pleaded guilty last month to one count of aggravated assault, under a plea deal. He was originally charged with three counts of fourth degree criminal sexual conduct.

District Judge John Foresman admonished Zych and handed down the maximum one-year sentence allowed under the plea agreement.

"You used your position as deputy sheriff to put her in a position which made her vulnerable. And that kind of conduct cannot be tolerated," Foresman told Zych in court Monday.

The prosecutor alleged that Zych used force and coercion while sexually assaulting a female victim on at least three occasions in 2009, manipulating his position over her.

Zych had worked in the Benzie County Sheriff's Department since 1997. The department terminated earlier this year.

BEULAH -- A former Benzie County Corrections Deputy, accused of sexually assaulting a woman, pleaded guilty to Aggravated Assault Monday.

Rick Zych was accused of groping a woman three times after he pulled her over in a Sheriff's vehicle earlier this year.

As a part of the plea bargain Zych had to admit to at least one count of Criminal Sexual Conduct fourth degree.

Zych faces up to one year in jail when he is sentenced on December 20.

BAY CITY — A former Saginaw County Sheriff’s deputy is to spend time behind bars for a sex offense.

John T. Yeska Jr., who resigned as a deputy in 2003 after being accused of sexually assaulting a woman in Saginaw County, was sentenced today for a crime that occurred last year in Bay County.

Circuit Judge Kenneth W. Schmidt ordered the 40-year-old Saginaw Township man to serve 270 days in jail for gross indecency between a male and female, a five-year felony.

Yeska pleaded no contest in October. A no contest plea is not an admission of guilt but is treated as such for the purpose of sentencing.

Schmidt also ordered Yeska to serve 90 days on electronic monitoring and five years on probation, prohibited him from using a computer for social networking purposes and ordered him to complete sex offender treatment.

The judge further deferred another 90 days in jail pending further order of the court and imposed $2,600 in fines and fees.

Yeska will not have to register as a sex offender because his victim was not a minor, prosecutors have said.

Yeska was charged with first-degree criminal sexual conduct causing injury, second-degree criminal sexual conduct causing injury and assault with intent to commit sexual penetration after a Hampton Township woman reported that he had sexually assaulted her Aug. 19, 2009, at her home.

The pair had met on an Internet networking site and met for the first time that day, according to reports.

After having dinner at a Bay City restaurant, Yeska drove the woman to her home, followed her inside and forced her to have sex with him, the victim told investigators.

Yeska had claimed the sexual encounter was consensual.

In January 2003, after seven years of service, Yeska resigned from the Saginaw County Sheriff's Department amid allegations he fondled a woman in his patrol car, Bay City Times archives show.

Though deputies investigated the matter, Saginaw County Prosecutor Michael D. Thomas denied a warrant request, citing insufficient evidence.

BAY CITY — A former Saginaw County Sheriff’s deputy charged with several felony sex crimes in Bay County has accepted a plea offer, rather than have his case decided by a jury.

Tuesday, John T. Yeska Jr., 40, of Saginaw Township, appeared before Bay County Circuit Judge Kenneth W. Schmidt and pleaded no contest to gross indecency between a male and a female. In exchange, prosecutors agreed to dismiss single counts of first-degree criminal sexual conduct causing injury, second-degree criminal sexual conduct causing injury and assault with intent to commit sexual penetration.

A no contest plea is not an admission of guilt, but is treated as such for the purpose of sentencing.

Though the charge Yeska pleaded to is punishable by a maximum of five years in prison, prosecutors are recommending he be sentenced to statutory probation, said Bay County Assistant Prosecutor J. Dee Brooks.

Before accepting his plea, Schmidt advised Yeska the recommended sentence could still include one year in jail and five years probation.

Yeska will not be required to register with the Michigan Sex Offender Registry, as his victim was not a minor, Brooks.

The charges against Yeska stem from an incident that occurred Aug. 19, 2009, in Hampton Township. On that day, Yeska went on a date with a local woman he had met on the Internet, court records show.

The woman told Hampton Township Police officers that on the drive back to her home, Yeska allegedly forced her head into his lap. Yeska then followed her inside her home and sexually assaulted her, the woman told police.

Yeska had claimed the sexual encounter was mutually consensual, Bay City Times archives show.

In January 2003, after seven years of service, Yeska resigned from the Saginaw County Sheriff’s Department amid allegations he fondled a woman in his patrol car, Times archives show.

The incident allegedly occurred in Pine Grove Park in Shiawassee County, where Yeska reportedly took the woman after a traffic stop in Oakley, Times archives show.

Though deputies investigated the matter, Saginaw County Prosecutor Michael D. Thomas denied a warrant request, citing insufficient evidence, Times archives show.

Schmidt is slated to sentence Yeska at 8:30 a.m. on Dec. 13.

ADB Tri-County Hearing Panel #106 reprimanded Warren attorney Sophie Modelski effective Dec. 1, 2010, the State of Michigan Attorney Discipline Board reported this week.

Modelski, licensed to practice law in Michigan in 1982, entered a plea of no contest to allegations that she neglected a bankruptcy matter, failed to seek the lawful objectives of her client, failed to act with reasonable diligence and promptness, and failed to keep her client reasonably informed of the status of the matter. Based upon the stipulation of the parties, the panel reprimanded Modelski and assessed costs of $767.26.

In another recent Attorney Discipline Board action, Kalamazoo County Hearing Panel #4 suspended Stevensville attorney and former Fifth District Court Judge Lynda A. Tolen from the practice of law in Michigan for a period of 180 days effective Nov. 30, 2010.

Tolen’s misdemeanor conviction for operating while intoxicated formed the basis for the disciplinary action. Based upon the stipulation of the parties, the panel suspended Tolen for 180 days, imposed conditions relevant to the established misconduct, and assessed costs of $755.71.

ST. JOSEPH - Retired Berrien County Trial Court Judge Lynda Tolen, who has faced drunk driving charges in the past, was back in court this week on charges of domestic violence.

Tolen, 60, of Stevensville, who retired in 2008 after 21 years as a judge, was arraigned Tuesday on the misdemeanor charge, according to a report from WNDU-TV.

The complaint, which Chief Assistant Prosecutor Michael Sepic showed to The Herald-Palladium, stated that Tolen had assaulted a woman named Lisa Brasseur.

The complaint lists Brasseur as a resident or former resident of the same household as Tolen.

Tolen was arrested Dec. 22 and released the next day on a $1,500 bond. On conviction, the charge carries a sentence of up to 93 days in jail and/or a $500,000 fine.

In 2010, while she was on probation for impaired driving in Leelanau County, Tolen was arrested in St. Joseph for drinking and driving.

Police reported she had a blood-alcohol level three times the legal limit.

That case was moved to St. Joseph County, and Tolen served 20 days in jail after being convicted on the charge.

Sepic told WNDU-TV that he has petitioned the state attorney general's office to disqualify his office from the most recent case because of Tolen's previous position with the court.

MUSKEGON — A longtime Muskegon County Sheriff’s deputy has been charged with domestic violence.

Keith Melton, 47, of Muskegon, a corrections officer for the Muskegon County Jail, was arraigned in Muskegon County’s 60th District Court on one count of first-offense domestic violence, a misdemeanor, before Judge Andrew Wierengo III.

The judge ordered a $3,000 signature bond. Melton entered a not guilty plea and indicated he’s hired his own attorney, according to court records.

A pretrial is slated for Nov. 29. Melton remains employed with the sheriff’s office while an internal investigation is ongoing.

According to Muskegon County Sheriff Dean Roesler, the incident occurred around 7:40 a.m. Nov. 9 at his ex-wife’s home in the 1500 block of Fifth Street.

“He was questioning his ex-wife about why their son wasn’t allowed to play basketball,” Roesler said. “That escalated into an argument. The allegation is that Melton entered the house uninvited and physically assaulted her by pushing her inside the house.”

The woman then reported the incident to police.

Roesler said Melton will be “disciplined internally.”

“We are reviewing the complaint internally and the appropriate disciplinary action will be taken,” Roesler said.

Melton could face anything from suspension to firing, he said.

Roesler said Melton has had “a clean record” and has been “a solid worker” prior to the allegations of the assault.

“I expect my staff to be professional on or off the job and to conduct themselves in a professional manner,” Roesler said. “This type of conduct is disappointing and it’s out of the norm for this particular employee.”

ISHPEMING -- The former Ishpeming police officer charged with one count of misdemeanor domestic violence was sentenced Tuesday at Marquette County District Court in Ishpeming.

Ron Schultz, 37, plead guilty to the charge. The victim came forward in August.

After a full investigation by the Michigan State Police, Schultz was charged with misdemeanor domestic violence.

Tuesday, he was fined over $600 and will see no jail time unless he fails to pay the fines in a timely manner.

If the fines are not paid by October 15, Schultz will have to report to jail. He will have to spend one day for each $50 he owes.

According to officials, the incident occurred with a family member at the officer's home between 2005 and 2006.

Schultz resigned from the Ishpeming Police Department on Sunday.

Criminal charges against Deputy Calhoun center around the sex acts that he forced a female living with him at his residence wtith him, to perform. Calhoun is also charged with beating her and choking her.

According to the Judge in the case, Deputy Calhoun also threatened his victim with a gun. He told the victim that he would kill family members, "one by one"






Deputy Roderick is looking at the possibility of life behind bars.








The Judge ordered Deputy Calhoun held without bail, in the Oakland County jail. Calhoun was charged with 11 felonies: 4 counts of first degree criminal sexual conduct; 4 counts of third degree criminal sexual conduct; assault with intent to do great bodily harm; felonious assault; and felony firearm.



LIVONIA, Mich. - 42-year-old Roderick Calhoun has 14 years of service as a deputy in the Wayne County Sheriff’s Department. However, he could face the rest of his life behind bars.

Calhoun faces eleven separate felony counts for sexual assault, assault with intent to do great bodily harm and weapons charges. He is accused of forcing a 24-year-old woman to perform sex acts on him at a home where they both reside Tuesday morning.

Livonia Police say the woman is a relative. Calhoun is accused of beating her with a belt and choking her while forcing the sex acts.

The lead detective in the case told the judge Calhoun allegedly threatened his victim with a gun, telling her he would kill family members one by one, the order in which he would kill them and then take his own life.

Calhoun works in Juvenile Services in the sheriff’s department. He has no criminal record, and is an officer in the military reserve. He’s been suspended from the sheriff’s department without pay.

Police say they have considerable physical evidence and corroboration in the case against Calhoun.

The judge ordered him held without bond at the Oakland County Jail.

LIVONIA, Mich. (AP) — A 42-year-old Wayne County sheriff's deputy has been charged in the beating and sexual assault of a woman.

County Prosecutor Kym Worthy says Roderick Calhoun was arraigned Friday on four counts of first-degree criminal sexual conduct, four counts of third-degree criminal sexual conduct, felonious assault and other charges.

Worthy says the victim was forced at gunpoint to perform multiple sex acts, beaten with a belt and choked.

Calhoun is suspended by the sheriff's department and was being held without bond pending a Sept. 28 preliminary examination.

The Associated Press left a message Friday seeking comment from Douglas Gutscher, Calhoun's attorney.

It's been a tough news cycle for the Wayne County Sheriff's Office, where reports indicate two deputies face accusations in separate off-duty incidents involving guns, women and poor judgment.

First up, Channel 7 reports deputy Roderick Vincent Calhoun has been suspended and faces criminal charges after he allegedly assaulted a female relative at gunpoint.

WXYZ.com, Sept. 17: Police say Calhoun assaulted a 24-year-old female relative who lives in the same Livonia house that he does. Investigators say he forced the woman to perform multiple sex acts at gunpoint. He is also accused of beating the woman with a belt and then choking her.

Wayne County Prosecutor Kym Worthy says "These are very serious charges and we will treat the prosecution of Roderick Calhoun just as we would any other defendant."

Calhoun is being held without bond on four counts of first-degree criminal sexual conduct, four counts of third-degree criminal sexual conduct, assault with intent to do great bodily harm, felonious assault and felony firearms possession.

Meanwhile, Fox 2 reports deputy Anthony Binion has been asked to turn in his gun after he allegedly pulled it outside a local bar on ladies' night. According to a police report filed last week, a man says Binion was making out with his wife and threatened to kill him when confronted.

Binion denies the husband's account and continues to work at the county jail as authorities investigate.

Roderick Vincent Calhoun has been charged with four counts of 1st degree Criminal Sexual Conduct, four counts of 3rd Degree Criminal Sexual Conduct, Assault with Intent to do Great Bodily Harm, Felonious Assault and Felony Firearms. Investigators say during the commission of the crimes, he threatened to kill his family.

Police say Calhoun assaulted a 24-year-old female relative who lives in the same Livonia house that he does. Investigators say he forced the woman to perform multiple sex acts at gunpoint. He is also accused of beating the woman with a belt and then choking her.

Wayne County Prosecutor Kym Worthy says "These are very serious charges and we will treat the prosecution of Roderick Calhoun just as we would any other defendant."
His defense attorney did not comment after today's arraignment.

Calhoun is being held without bond. He has already been suspended from the Wayne County Sheriff's Department where he has worked for 14 years.

After that, he showed her a handgun and forced her to perform sex acts. He also tried to choke her. The victim reported the crime to the Livonia police. Shortly after, law enforcement agents arrested the 14-year veteran.

"These are very serious charges, and we will treat the prosecution of Roderick Calhoun just as we would any other defendant," prosecutor Kym Worthy said.

Calhoun has been suspended from his job at Wayne County Sheriff's Office. He faces a maximum penalty of 15 years in prison, if he is found guilty.

Roderick Vincent Calhoun, a 14 year veteran of the Wayne County Sheriff's Department, has already lost his job and may lose his freedom, potentially for life. He was arraigned earlier today on sexual and physical assault charges stemming from the serial rapes of a 24 year old relative.

Police say Calhoun forced the woman, who had lived in his Livonia home, to perform sexual acts at gunpoint. He reportedly beat the woman with a belt and choked her. He threatened to kill other family members if she failed to cooperate.
The Wayne sheriff's office has suspended Calhoun.

The former deputy was arraigned in Livonia's 16th district court on a number of very serious felony charges. They are: four counts of Criminal Sexual Conduct in the first degree (CSC-1), four counts of CSC-3, assault with intent to do great bodily harm, felonious assault, and felony firearm. Conviction of CSC-1 exposes a defendant to a maximum of life in prison.

The name of the victim is being withheld due to the nature of the charges. Beyond saying the victim is a relative of Calhoun, the nature of the blood relationship has not been specified.

Police report filed by the husband of Deputy Binion's female friend, who claims that Binion pulled out his gun during the altercation.















On September 11, 2010 Deputy Anthony Binion went out to a bar in Detroit with a female friend, [who is married].















The husband of the woman who Deputy Binion was with, spotted her husband as they walked out of the bar. The stories over what happened next differ...














According to Deputy Binion, he and his female friend were just talking. When his friend spotted her husband, she remarked, "Oh God, there's my husband". The husband grabbed the woman and told her, "Get your ass in the car". Deputy Binion said he told the husband, "Don't grab her". The husband reportedly told Deputy Binion, "You're a dead mother f***er".












According to the husband of Deputy Binion's female friend: He claims that he saw Deputy Binion and his wife kissing. Binion threatened to kill him and showed him his gun.















Deputy Binion maintains that he did have his gun on him that night, but that he did not brandish it.



















Deputy Binion has been stripped of his badge and his gun, during the Wayne County Sheriff Department's investigation of the altercation.














Deputy Binion is still working at the Wayne County jail, while the matter is under investigation.



















Fourteen years ago, Deputy Binion had been accused of shooting someone. He had been cleared of all charges when he was linked to that murder.

Wayne County Deputy Reportedly Pulled Gun While Off-Duty

A Wayne County Sheriff’s deputy has been stripped of his badge and gun for what he’s accused of doing off-duty. That deputy reportedly pulled his gun on a guy at a bar off the clock, and it’s not the first time he’s been investigated.


"She walked down the street. We were talking on the fence like that, and she looked up and she said, `Oh God, there’s my husband,’ said Wayne County Deputy Anthony Binion.

It was a night Binion will never forget; an altercation that has Detroit Police investigating.

 

"I had a weapon, but I didn't brandish it,’ Binion said.

He’s had to turn over his gun and badge for the time being. According to a police report, he was at ladies’ night at a downtown bar about a week ago, but when the lady friend he was with saw her husband show up things got downright ugly.

"He said get your (expletive) in the car, just like that," said Binion.
"I said, `Don't grab her.’’

"He turned around at me and looked and said, `You're a dead (expletive).’ That's exactly what happened,’ he added.

The husband tells a different story to cops, claiming Binion and his wife were kissing, and then Binion threatened to kill him and even showed his gun.

All three separated without things going any further.

A 26 year veteran, Binion is still working the jail. His lady friend is also a county employee.

Earlier in his career, the deputy was cleared of all charges after being linked to a murder.

"This is the second time I've been through this. I was accused 14 years ago of shooting somebody,’ Binion said.

We reached the husband by phone, but he told us no comment and then hung up.
