05012026 - Why Would DV Agencies Falsely Claim To DV Victims That Federal Law Does Not Protect Victims Of Dating Relationships??? WHY???

 

Flash back to 2021-2022, when federal legislators and DV agencies were attempting to attach Red Flag laws (unconstitutional gun bans) to the VAWA reauthorization bill. Legislators and DV agencies terrified the public/victims into (falsely) believing there was a "Boyfriend Loophole" in the federal Lautenberg DV Gun Ban law (18 USC § 922(g)(8) )    that did not cover DV victims who weren't married to their abusers - in order to push their hidden agenda to remove guns from US citizens without due process/violation of the 2nd Amendment.

Fortunately, the VAWA reauthorization bill was passed, WITHOUT the red flag laws. In response to the failure of their hidden agenda, Charisse Mitchell (CEO of YWCA West Central Michigan), held strong to the false claim that the Lautenberg Amendment did not protect ALL DV victims...







Why would a DV advocate publicly claim to victims that protections under a law does not apply to them? Not only is it irresponsible - but it's dangerous to the victims.

18 USC § 922(g)(8) / Federal Lautenberg DV Gun Ban clearly states, "Any Person" - as does every law on the books. Laws do not exclude people from being protected - as legislators and DV falsely claim.

  1. Most likely because their experience is not the same as the law was written. Because they want the people they help to continue breathing and it would be irresponsible to imply a police officer is treated the same as an abuser who does not work alongside the responding officers. They want their people to live, it is devastating to lose a client. I got lucky , I'm still here. The family court judge in our case had gone to Christmas parties at my ex's uncle's house. Do you really think that's fair? My ex got away with so many violations of orders of protection and I believe it is partially because the judge and his police officer uncle were friends. He was brought back into court directly after stalking me right outside the courthouse. One time after my lawyer has asked a court officer to walk to my car with me which really made me feel protected . Until the officer rounded the corner walking away and my ex rolled right up on me. You'd think that'd be a charge but no. I had an officer in Coeymans refuse to write he said he was going to "put a bullet into all four of our brain pans." But "don't worry, I'll kill you first do you don't have to watch our boys die." The officer would only write " threatened to harm them ". No, he promised to murder us. I had another officer refuse to take stalking seriously saying " Brake ups are hard l. Especially for men." They're letting their clients know the truth, an order of protection IS just a piece of paper. A police officer in my ex's shoes would have gotten away with even more. Hell, a police chief from Cambridge NY was reinstated after his DV charges. Which got reduced by the way The freaking police chief is an abuser and you expect women to feel safe calling them for help when it's clear they let their own get away with it and are in the abusers side, not the person getting hurt, demeaned, belittled and terrorized .
    I could be wrong, hunny I hope I am. I'm also most likely answering a rhetorical question, but it is one you asked so I gave you my thoughts on it. I hope I'm wrong but experience tells me that I'm right, I truly wish you were on the money and theaws actually worked the way they're supposed to. My ex gifted me with disabilities that prevent me from working. He's such an asshole . I wish he was a better man. I wish he could at the minimum be a kind and loving father now that the boys are grown. Well I wished in one hand and pissed in the other and guess which one filled up first. Be safe out there, lots of avuuserd look great on paper and are loved by people they don't show their ugly side to
