On December 26, 2007 Rose Cobb was brutally gunned down while she sat in the family van in the parking lot of a Detroit CVS store...while her husband [Officer David Cobb, Detroit PD], was inside the store. Officer David Cobb was immediately suspected in Rose's murder. Police uncovered that Officer Cobb had hired hitman Vincent Smothers to kill Rose.

A neighbor of Rose's said that she was "a very nice lady...very compassionate..."





Days after Rose was viciously gunned down, Rose's family and father gathered at a candlelight vigil on a cold winter night - in the CVS parking lot where Rose had been murdered. Rose's husband/Officer David Cobb was not present at the vigil.

Police are continuing their investigation into Officer David Cobb's connection to Rose's murder


Officer Cobb was released after his arrest, as there was not sufficient evidence to charge him in connection to Rose's murder


However, the Wayne County Prosecutor's Office had sufficient evidence to charge hitman Vincent Smothers in connection with Rose's murder


After Rose's murder, the Detroit Police Commission had suspended with pay. After Cobb's arrest, the Commission changed Cobb's suspension to UNPAID.


Officer Cobb's attorney [Fred Walker] argued with the Commission that Cobb had not been charged in connection to the murder, and thus his pay status during his suspension should not be changed from 'paid' to 'unpaid'.


The Detroit Police Chief and the Commission ruled to change Officer Cobb's suspension to UNPAID during the investigation of Rose's murder.

Defense claims Vincent Smothers was coerced into confessing to Rose Cobb's and 8 other murders

After his arrest in April 2008, Vincent Smothers confessed to police that he was a hired hitman. He signed a confession stating that he had killed Rose Cobb and eight others.


Smothers' defense attorney [Gabi Silver] argued in a recent hearing that he had been coerced into confessing to the murders.


The defense claimed that the police had threatened to arrest and charge Smothers' wife as an accomplice in the murders, if he did not confess to the murders...


...that Smothers had signed the confession after hours of interrogation...


...and while under duress.


Smothers and his defense attorney were thus requesting that the Court throw out his confession to the police from April 2008.


In the confession that Smothers now wanted thrown out, was his admission that he had been hired by Officer Cobb to kill Rose....And that Cobb had given him $50 towards the contract before he killed Rose.


Smothers also claimed in the confession that Rose Cobb was the only murder that he had committed that did not involve a drug dealer.


Police officers testified at the hearing that Smothers had not been coerced into confessing / signing the confession to the murder of Rose Cobb and eight others.

In a plea agreement, Vincent Smothers pled guilty to eight counts of second degree murder. Rose Cobb was one of the victims.

Rose Cobb. Murdered December 26, 2007, by hitman Vincent Smothers...who had been hired by her husband, Officer David Cobb.


Officer David Cobb was immediately considered 'a person of interest' following the murder of his wife, Rose. Cobb was arrested in April 2008 [along with Smothers], but there was not enough evidence to charge him with Rose's murder. Cobb was released, and in September 2008, he committed suicide.


Investigators believe that Officer Cobb's motive in murdering his wife was money from her life insurance policy.


Vincent Smothers was arrested in April 2008. He soon confessed to police that he was a hitman who had been hired by Officer Cobb to kill Rose.

"...A form of closure. He [Officer Cobb] was supposed to protect her. He did none of that and plus he was a cop. It was his job to protect and serve. He couldn't even do that for his own wife...Sometimes you feel like you're all cried out. You just want to go on and see something concrete done and this was it today...."


Under the plea agreement, Smothers will remain locked up until at least 2060

There was a delay in Smothers' sentencing hearing. Smothers' had managed to get a cell phone into his jail cell, and the eight floor of the Courthouse was on lockdown.


Smothers' family said that Vincent was a good kid when he was growing up. He changed after his 15 year-old sister was gunned down in their driveway.


Smothers' sentencing is of importance to Davontae Stanford. Davontae [who is mentally handicapped] pled guilty to taking part in a drug house hit. Smothers claims that he and another accomplice did that hit....not Standford.


One of the murders that Smothers is pleading to, is that of Rose...A hit that was order by her husband, Officer David Cobb [12/26/2007].

A Detroit hit man who pleaded guilty to killing eight people has been sentenced to 52years in prison after a sharp rebuke from a judge who felt there wasn't enough remorse.

The 52-year minimum sentence was part of a deal struck in June when Vincent Smothers pleaded guilty to second-degree murder.

He avoided a mandatory life sentence, but he won't be eligible for parole until he's about 80.

Wayne County Judge Craig Strong read from a pre-sentence report Friday in which Smothers said he had killed more than eight people, but couldn't recall their names.

Smothers told police he was paid $60,000 for a series of killings. His last victim was Rose Cobb, the wife of a Detroit police officer, in 2007.

People who were related to two victims spoke before Smothers got his punishment.

Monica Cherry. Her husband Clarence was killed by Smothers. She gave a victim impact statement detailing how Smothers' murder of her husband had shattered her life.


Rose's sister Cheryl stressed to Smothers that "peoples' lives are important. Your life is important. You have people in this courtroom today that care about you...."


Judge Strong was concerned that Smothers had confessed to murders that were not part of the plea deal.


The confession detailed a murder of four people on Runion's East Side. Davontae Stanford was in prison for those killings that were committed by Smothers and another person.


Davontae Stanford who is currently in prison for four murders that Smothers confessed to.


Because Davonte Stanford made a written confession, Prosecutor Kim Worthy is fighting efforts by Standford to get a new trial to reverse a wrongful conviction.


"I'm bringing this to your attention because you cannot bring back those you killed. But you can correct wrongs for those who were wrongfully convicted of people that you killed," Judge Strong stated to Smothers.


"If that's a question," Smothers responded to Judge Strong, "The police department knows about any crimes that have been committed."


Smothers was sentenced to 50 - 100 years in prison for eight murders. One of those murders included the contract killing of Rose Cobb that was ordered by her husband, Officer David Cobb

SUSPENSION WITHOUT PAY OF POLICE OFFICER ADAM HORNE, BADGE 974, ASSIGNED TO THE WESTERN DISTRICT

On December 24, 2007, Force Investigation responded to shots fired by off duty Police Officer Adam Horne. At approximately 12:00 pm, Officer Horne’s wife was visiting a male friend at 3075 Newport in Detroit when the home was fired upon with an AR-15. Her male friend was not at home at the time of the incident. However, upon his return, Officer Horne’s wife was hysterical and shouted, “Adam shot up the house!”

Prior to Force Investigation’s arrival, the male friend recovered eight shell casings from the front of the location and placed them in a plastic baggie. Crime Scene Services responded and processed the scene. Force Investigation assigned the matter to the Eastern District Investigation Operations for criminal investigation and to contact Force Investigation immediately if the investigation revealed misconduct by a department member.

On December 28, 2007, Force Investigation was informed by the Eastern District Investigation Operations that the female involved was Officer Horne’s wife and that Officer Horne had checked himself into Henry Ford Macomb Hospital for psychological examination.

On December 29, 2007, Officer Horne’s wife failed to come in to give a statement. Force Investigation was also informed that the male friend had a voicemail recording of Officer Horne leaving a message and apologized for his actions and offered to pay restitution for the damage he caused. The recording was preserved as evidence. Due to the additional information obtained concerning the allegations, Force Investigation assumed responsibility of the criminal investigation.

On December 29, 2007, Force Investigation was informed that Officer Horne had been discharged and may have been transferred to the Henry Ford Macomb Hospital, Mt. Clemens Campus, located at 215 North Avenue, Mt. Clemens, Michigan. Force Investigation determined that Officer Horne was not in their care.

On December 29, 2007, Force Investigation and Clinton Township Police Department responded to Officer Horne’s residence. Officer Horne was at the location and stated as a condition of his release from the hospital, he had his firearms transported to his mother’s house. Force Investigation read Officer his Miranda Rights and he refused to give a statement. Lieutenant Anthony Topp suspended Officer Horne and collected his police identification and cap shield. Officer Horne was also at the location and refused to give a statement.

On December 29, 2007, Force Investigation went to Officer Horne’s mother’s home, and spoke with Ms. Horne, who voluntarily turned over a Bushmaster AR-15 rifle and a privately owned .40 caliber Glock, both belonging to Officer Horne.

On December 30, 2007, Assistant Prosecuting Attorney Jennifer Tink of the Domestic Violence Division stated that she would prefer that the firearms evidence be tested prior to the approval of the Investigator’s Report.

On December 31, 2007, the firearms evidence was submitted to the Firearm Identification Unit. Force Investigation requested that a priority be placed on the analysis of the evidence.

On January 3, 2008, Force Investigation was informed by the Firearms Identification Unit that the ballistics matched the Bushmaster AR-15 rifle.

Based on the above circumstances, it is recommended that Officer Horne be charged with, but not limited to, the following violation of the Detroit Police Department Rules and Regulations:

CHARGE: CONDUCT UNBECOMING AN OFFICER, CONTRARY TO THE LAW ENFORCEMENT CODE OF ETHICS; THIS BEING IN VIOLATION OF THE 2003 DETROIT POLICE DEPARTMENT MANUAL SERIES 100, DIRECTIVE 102.3 –7.9, CONDUCT UNPROFESSIONAL, COMMAND 1.

Due to the seriousness of the conduct, I am requesting your concurrence with the suspension of Officer Horne without pay, effective January 3, 2008.

Unless contravened by this Board, the suspension without pay will stand.

There were no contraventions.

SUSPENSION WITHOUT PAY OF POLICE OFFICER COLLIN EATON, BADGE 4871, ASSIGNED TO NORTHWESTERN DISTRICT
On December 14, 2007, Internal Affairs was notified of an allegation of misconduct concerning Police Officer Collin Eaton, badge 4871, assigned to Northwestern District. The allegation concerned the following conduct:

On December 14, 2007, Internal Affairs Alert Team responded to Northwestern District regarding an anonymous allegation that Officer Eaton had admitted to sexually assaulting his two stepdaughters (hereinafter, complainant 1 and 2) and had checked himself into the Detroit Receiving Hospital, Crisis Center.

Internal Affairs responded to Northwestern District, and was told by Lieutenant Geraldine Atkinson, badge L-24, assigned to Northwestern District, that Officer Eaton requested eight hours of Compensatory Time due to a family emergency.

The Alert team responded to DRH and spoke to the staff who confirmed that Officer Eaton was at the hospital waiting to be interviewed by a doctor, and he refused to speak to members of Internal Affairs.

On January 30, 2008, the school psychologist informed Internal Affairs that complainant #1, a minor child, said that she was sexually abused by her stepfather,Officer Eaton.

On February 15, 2008, an uncle of the victim was interviewed and he stated that Officer Eaton telephoned him and stated that he was going to kill himself.

The uncle went to Officer Eaton’s home and he (Officer Eaton) informed him that he forced complainant #2 to have sex with him and that his wife came home and caught him. On this same date, both complainants admitted to being sexually assaulted by Officer Eaton.

On February 22, 2008, the Wayne County Prosecutor’s Office recommended the issuance of two felony warrants charging Officer Eaton with six (6) counts of Criminal Sexual Conduct in the First Degree and two (2) counts of Criminal Sexual Conduct in the Second Degree. Subsequently, Magistrate Charles W. Anderson III, of the 36th District Court, signed Felony Warrant #08-56930 and #08-56931 for the recommended charges.

On this same date, at the Office of Internal Affairs, Officer Eaton was arrested and suspended with pay.

SOUTHGATE. A 38-year-old firefighter has been suspended without pay since last week after city officials learned of felony and misdemeanor charges against him.

City administrators took the action against Michael Boyd of Southgate after learning of the firefighter being charged with one felony count of aggravated burglary, three misdemeanor counts of assault and a misdemeanor charge for resisting arrest. Mayor Norma Wurmlinger said the information initially came through the Internet.

The mayor said Boyd is suspended without pay, as opposed to with pay, because of the felony charge. A decision on his employment is pending on the resolution of the case against him.

Wurmlinger said the suspension did not take place until officials had the complete police report on the incident.

The charges stem from an encounter Boyd had with an ex-girlfriend, her friend and the woman's father in Port Clinton, Ohio, on Aug. 16.

Wurmlinger said Fire Chief John Wlodkowski, along with the city and labor attorneys, were all in on the decision-making process to suspend the firefighter.

Wlodkowski has not returned calls for comment on the case.Boyd's attorney, Thomas DeBacco, was at a jury trial and initially could not be reached for comment.

He later told The News-Herald Newspapers: "I am honored to defend this young man who commits his young life to saving people and their property. I believe a jury is going to treat him quite favorably."

Boyd is accused of assaulting 25-year-old Melissa McCann, and her high school friend, Josh Large, 28, after driving to visit the woman and seeing the two together watching television.

According to a police report on the incident, McCann had noticeable bruises around both her eyes and upper left arm and Large, her friend and neighbor, also was attacked.

McCann ran to her father's house down the street and Boyd followed her, according to the police report. Police said Boyd kicked in 52-year-old Pat McCann's front door and when McCann tried to come between his daughter and Boyd the firefighter punched him in the lip, causing a bruise and a cut.

Police said Boyd left the house, but was spotted early the next day in a nearby trailer park.

Police officers found Boyd in a shed kissing a woman and said he refused to come out. He told officers they didn't have a warrant, a report said.

According to the police, Boyd was warned several times to come out of the shed and he became combative and attempted to push an officer in the chest when approached.

As they struggled, Boyd began using obscenities and informed police that he is a firefighter, the report says. After several more warnings, police said they sprayed Boyd with pepper spray and handcuffed him.

A pretrial hearing is set for 2 p.m. Oct. 29 before Judge Paul Moon of the Ottawa County Court of Common Pleas. A trial date is set for 8:30 a.m. Jan. 8.
